The world has changed. Many couples now move between different countries at different stages of their lives. If they then decide to separate, it can be difficult to decide where to initiate divorce proceedings.

The issues around international divorce are extremely complex, and it is important to get specialist advice at an early stage.

This becomes even more complicated in international divorce. We will ensure that your children remain the top priority. The first step in any divorce is when one spouse issues a divorce petition. Different countries have different divorce laws, and it is essential to consider this before the petition is issued.

For example, if a couple are originally from England* but now living in Dubai, and the wife decides to issue divorce proceedings, then it is likely that she will receive a better financial settlement if she issues the petition in England. If the husband pre-empts this by issuing a petition in Dubai then he could argue that the local court has jurisdiction (the power to hear the case).

Similarly, if a couple are originally from outside the UK, but now spend some of their time here, then it may be possible for one spouse to issue a divorce petition in England. This may be possible if at least one partner has been habitually resident in England for at least 6 months.
