Private Clients Pre-Charge Interviews, Regulatory Disclosure & Family Proceedings

Updated: Sep 18

The Royal Court of Justice, London

Garrick Law team secures best pre-charge engagement no further action required result, avoiding court proceedings and unnecessary stress for client.

The Garrick Law Private client department, led by Sunpritha Jutlla successfully engaged with Prosecuting authorities pre-charge in accordance with The Attorney General’s Guidelines on Disclosure. The outcome was the speedy resolution of the professional client’s case shortly after pre-charge, saving our client the unnecessary stress, trauma and cost of court proceedings.

The criminal allegations made by the complainant in this case against a professional client related to common assault, actual bodily harm, sexual offences and controlling and coercive behaviour all arising in a historic domestic setting. The complainant did not make any allegations until the couple separated and reported to the police, simultaneous with initiating family proceedings.

Mandeep Randhawa, at Garrick Law was in a position to oversee and guide the client in respect to the Family proceedings and the impact of any decisions made in the live criminal investigation.

Our professional client of impeccable character was arrested and made subject to police conditional bail, removing him from access to his family home. A successful bail variation resulted in the client being permitted to have a right to family life. The officers were directed to undermining material in the family proceedings, which in combination with written representations resulted in the investigating authorities conceding that the complainant had not been candid when making her complaints to the police.

The written representations which focused and invited the police to take specific investigative enquiries to confirm whether the complaints were malicious, and whether any manipulation had occurred, were followed up successfully. Garrick Law secured a 'no further action'. Our client retained his professional good standing, and avoided regulatory proceedings, defamation of character and the interruption to his childrens .life as well as his own.

It is often the case that given the nature of the allegations simultaneous with divorce or child separation proceedings, different sections of law can crossover and become relative to each other. Becuase of our unique expertise in both family and criminal law, this particular client was guided on all three aspects of his case; Criminal, Regulatory and Family by the Garrick Law team, led by Sunpritha Jutlla.

If you are suspected of involvement in any criminal or financial investigation then it is essential to take a proactive approach from the outset. Engagement of an experienced and respected defence team can often lead to an early resolution of a case and/or the case being dropped altogether.
