Garrick Law successfully represented a high-profile international client, who had been convicted of criminal charges, in his capacity as company director. The prosecution asserted the Director was the directing and controlling mind of the company. It was alleged that the company had failed to provide pre-requisite information.
A skilled defence team, under the instruction of Sunpritha Jutlla successfully challenged the Crown’s evidence, the approach of a local police force who had initiated the charges, via written advocacy.
At the hearing, the Crown conceded the appeal.
Outcome
The outcome was a formal acquittal of the client. Resulting in the successful restoration of good character, reputation and professional standing. As a Company Director, facing criminal liability for the actions of a business can be a
distressing ordeal for individual directors and companies, especially where disputes arise within the business as to where responsibility and insurance burdens may fall.
